Question for the group.....

My son did a permissive transfer to another high school his freshman year. Beacuase of a job change we are no longer able to drive him to school. If he transfers back to the high school we are zoned for will he have to sit out a year from varsity?

A whole lot of "if's" to your question.

It would look like he would have to sit out a year from varsity level. He could play sub-varsity.

According to the link below, 1.67.a classifies your permissive transfer student as a migrant student. 1.63 basically states that a migrant student transferring without a bona fide move isn't eligible for varsity for a year, but is eligible for sub-varsity.

There are a ton of exceptions to 1.63 listed in 1.62. It might be easier for your son to get married or for you to have someone adopt him.

Does this work or am I reading it as the answer I want?

1.62 A transfer student who has established eligibility at a former school in grades 9-12 shall be immediately eligible at the new school if:

3) the student has previously established his attendance at a school other than the school serving his area of residence, and chooses to return to that school, AND

(4) it is the initial move of the student from a non-member school to a member school serving his area of residence.

I don't think you're reading the stipulation in it's entirety. The actual flow you need to look at is:

1.62.(c).(3).(4) You left out the (c), under which the (3) & (4) is a subset. They don't use any indentation on the web page, so it isn't very clear. So, including the (c) it actually reads:

A transfer student who has established eligibility at a former school in grades 9-12 shall be immediately eligible at the new school if:
(c) The student was enrolled in a non-member private school in Georgia or was boarded at a school out of state and, without a bona fide move, transferred to a GHSA-member school that serves his area of residence as long as:
(3) the student has previously established his attendance at a school other than the school serving his area of residence, and chooses to return to that school, AND
(4) it is the initial move of the student from a non-member school to a member school serving his area of residence.

So unless the school you are attending now is a non member private school or he's boarding at an out of state school, that wouldn't seem to apply.

Loses a yr of eligibility barring a miracle. Had one that didnt inform was caught and cost their team all wins and was suspened from play.

my son transferred schools after his freshman year and got an exception. here is what you need to do;

1. meet with the a-d at the new school asap.

2. craft a story around a hardship. the hardship issues occur quite a bit. they get reviewed by the ghsa and many times they get approved.

Doesn't sound like they need to "craft" a story around a hardship, sounds like their is a hardship. New job, no transport. Maybe I'm too reasonable a person, but seems reasonable to me!
